UK-EU-Spain-Gibraltar treaty, 2026

A treaty removing border checks and the physical border fence between Spain and Gibraltar was signed, while explicitly preserving British sovereignty.

What happened

On 15 July 2026, a treaty between the United Kingdom, the European Union, Spain and Gibraltar was signed, providing for the removal of border checks and Gibraltar's effective participation in the Schengen area's free movement of people, without Gibraltar formally joining the EU customs union or Schengen area as a member.[1] The physical border fence and land checkpoints in place since 1908 were removed the same day; Gibraltar residents may now cross using residence cards without a passport stamp, and Spanish citizens may enter using a government ID card.[2]

Under the new arrangement, both British/Gibraltar and Spanish officials conduct entry checks at Gibraltar's airport and port on behalf of the EU, an arrangement compared to the juxtaposed-control system between London and Paris on Eurostar.[3] The treaty explicitly states that it safeguards British sovereignty over Gibraltar, including its territorial waters, and protects the autonomous operation of UK military facilities.[4] It was signed by EU Trade Commissioner Maroš Šefčovič, UK Minister Stephen Doughty, Spanish Foreign Minister José Manuel Albares, and Gibraltar Chief Minister Fabian Picardo.[5]
