On 31 March 2005, the UN Security Council referred Darfur to the ICC, which later charged President Omar al-Bashir with genocide, war crimes and crimes against humanity; neither arrest warrant has been enforced.[1]

Claim: On 31 March 2005, the UN Security Council referred the situation in Darfur to the International Criminal Court; the ICC subsequently issued arrest warrants against then-Sudanese President Omar al-Bashir, including charges of genocide, war crimes and crimes against humanity — the first genocide charge brought by the ICC against a sitting head of state — though neither warrant has been enforced and al-Bashir has not been in ICC custody. In July 2023, the ICC announced it would investigate new allegations of war crimes and crimes against humanity in Darfur under its existing mandate.
